General Terms and Conditions of Sale of L'Optique Durable Académie

These general terms and conditions of sale (referred to as “GTC”) apply, without restriction or reservation, to all sales concluded by L’Optique Durable Académie with consumers and non-professional buyers (“the Clients or the Client”), wishing to acquire the services offered for sale by the Seller, namely participation in custom eyeglasses creation workshops.

Article 1 – Legal Information

These GTC belong to the company L’Optique Durable Académie, a SARL (limited liability company) with a share capital of €1,000.00, whose registered office is located in Paris, registered with the Paris Trade and Companies Register under number 938 112 638.

Article 2 – Purpose and Scope

These GTC govern the sale of Do-It-Yourself eyeglasses creation workshops organized by L’Optique Durable Académie. They outline the terms of booking, participation, cancellation, and payment.
Any workshop booking implies full and unconditional acceptance of these general terms and conditions of sale by the Client. The Client acknowledges having received, prior to placing their order, clear and understandable information including these GTC and all the elements listed in Article L. 221-5 of the French Consumer Code.

Article 3 – The Workshops

L’Optique Durable Académie offers workshops allowing the Client to create their own eyeglass frame, guided by a skilled eyeglass craftsman. A detailed description of the workshops (duration, process, materials, etc.) is available on the website https://www.optiquedurable.fr/atelier.
The frames created are unique pieces. L’Optique Durable Académie is not authorized to provide prescription lenses. The Client may later have lenses installed by L’Optique Durable SAS – 2 rue Amelot or an optician of their choice.

Clients with a valid medical prescription who have corrective lenses fitted by L’Optique Durable SAS may be eligible for partial reimbursement of the frame by their health insurance and mutual insurance provider.

Article 4 – Booking and Payment

Booking a workshop can be done online or on-site. The booking process is as follows:

  1. Select the workshop and date.
  2. Enter personal information.
  3. Secure online payment of the full service amount.

The booking is confirmed only after full payment has been received. The Client then receives a confirmation email summarizing their booking details. Prices are in euros (€) and include all taxes (VAT included).

Article 5 – Gift Card

**5.1. Purchase and Purpose** L’Optique Durable Académie offers gift cards for sale. Each gift card corresponds to the value of one spot in an eyeglass creation workshop. It allows the recipient to book the workshop of their choice, subject to availability.
5.2. Validity Period
The gift card is valid for twenty-four (24) months from the date of purchase. After this period, the gift card code expires and can no longer be used. The card is neither refundable nor exchangeable.

5.3. Use
The gift card recipient must visit https://www.optiquedurable.fr/atelier to book their workshop date. They must enter the unique code from the card at checkout to validate the booking. The card may only be used once.

Article 6 – Right of Withdrawal

In accordance with Article L. 221-28 12° of the French Consumer Code, the right of withdrawal cannot be exercised for service contracts related to leisure activities that must be provided on a specific date or within a specific period. Therefore, the Client does not have a right of withdrawal for workshop bookings with fixed dates.

Article 7 – Cancellation, Rescheduling, and Absence

7.1. Cancellation by the Client
All requests for cancellation or rescheduling must be made by email (your email address) at least 3 days before the scheduled date of the workshop.

  • Rescheduling possibility under conditions: L’Optique Durable Académie may, at its sole discretion, offer the Client a new workshop date.
  • Absence on the day of the workshop: If the Client does not show up at the scheduled date and time, the booking will be rescheduled later with a surcharge of €70 and will not be eligible for a refund.

7.2. Cancellation by L’Optique Durable Académie
L’Optique Durable Académie reserves the right to cancel or postpone a workshop in cases of force majeure or insufficient participant numbers. In such cases, the Client will be informed as soon as possible and may choose between:

  • Rescheduling to a later date, free of charge.
  • Full refund of the amount paid.

Article 8 – Participation and Refund Conditions

Full participation in the workshop constitutes full performance of the service by L’Optique Durable Académie.
Once the Client has attended the workshop, no total or partial refund can be requested, regardless of the reason.
Polishing your frame requires a minimum of 72 hours of tumbling. After the workshop, an appointment will be scheduled for the pickup of your glasses a few days later.

Article 9 – Liability

L’Optique Durable Académie takes all necessary measures to ensure workshops are conducted in the safest conditions possible. The Client agrees to follow all safety instructions provided by the facilitating artisan, particularly regarding the use of tools.
L’Optique Durable Académie cannot be held responsible for any damage caused to the Client or their property in the event of non-compliance with safety instructions.

Article 10 – Intellectual Property

All technical documents, products, designs, photographs, know-how, and methodologies provided to participants or displayed on the website “https://www.optiquedurable.fr” are and remain the exclusive property of SARL L’Optique Durable Académie and L’Optique Durable SAS, the sole holders of intellectual property rights over these materials. Clients agree not to use these documents in any way that could infringe upon the seller’s industrial or intellectual property rights and not to disclose them to third parties.

Article 11 – Personal Data

The Client has the right to access, modify, correct, and delete their personal data at any time, in accordance with the French Data Protection Act of January 6, 1978.

Article 12 – Applicable Law and Disputes

These GTC are governed by French law. In the event of a dispute, the Client must first contact L’Optique Durable Académie to seek an amicable solution.
If unsuccessful, and in accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the Client may refer the matter to a consumer mediator.

Any dispute related to the interpretation or execution of these general terms of sale is subject to French law. If an amicable resolution cannot be reached, the dispute will be brought before the Paris Commercial Court.
